Privacy Notice

To provide you with products/services, we need your personal data.  When you provide us with your personal data, we will do our utmost to protect the privacy of your data, and we would like you to be aware of the following:
 
“We” “Us”, “Our” in this notice refers to Maybank Ageas Holdings Berhad , Etiqa Life Insurance Berhad, Etiqa General Insurance Berhad, Etiqa Family Takaful Berhad, Etiqa General Takaful Berhad, Etiqa Life International (L) Ltd or Etiqa Offshore Insurance (L) Ltd (“Etiqa”), including its branches in Malaysia and in other countries as well as its local and overseas subsidiaries or, as the context may require, any of them.
“Maybank Group” in this notice refers to Malayan Banking Berhad, including its branches in Malaysia and in other countries as well as its local and overseas subsidiaries or, as the context may require, any of them.
 
 

When you request information or sign up for our products and services, you will be required to provide Etiqa with your personal data. In doing so, you consent to its use by Etiqa in accordance with this Privacy Notice.


We collect your sensitive personal data (including data relating to your physical or mental health, the commission or alleged commission of offences etc.) when you apply for certain products such as health or life insurance / family Takaful products, which require you to disclose such sensitive personal data to us. We will only use your sensitive personal data to provide the service(s) you signed up for. If we collect, use, maintain or disclose your sensitive personal data, we will ask for your explicit consent.


You have the choice, at any time, not to provide your personal data/sensitive personal data or to revoke your consent to Etiqa processing of your personal data/sensitive personal data. However, this may result in Etiqa being unable to provide you with the offered services.

We need your personal data:
  1. For identification purpose, and to authenticate communications with, and instructions received from, you;
  2. To fulfil legal and regulatory requirements obligations;
  3. For assessing your suitability with our products/services offered;
  4. For analysis and marketing purposes, so that we can develop and offer better products/services;
  5. To facilitate our operations, and for processing your transactions, and instructions;\
  6. For recruitment and employment;
  7. For ensuring security of our premises and systems;
  8. For audit purposes;
  9. For information sharing with other insurers, takaful operators and any other information sharing systems, which may include credit-rating systems.

We will collect personal data shall which include but not limited to the following that will enable us to:
Keep in contact with you,;
Assess your profile,;
Fulfill our legal and regulatory obligations,;and
Record details of your transactions/communications with us,; ;
Your personal data shall include but not limited to the following:
 
(i) Non-Sensitive Personal Information
1.  name and age;
2.  home/mailing address;
3.  NRIC/Passport No.;
4.  contact information, telephone number, e-mail address;
5.  biodata profile;
6.  photograph or video image;
7.  employment information;
8.  financial information;
9.  investment and risk preferences;
10. vehicle registration;
11. personal information of family members or next of kin/beneficiaries/nominees/trustees/ assignees; and/or
13. such other personal information required (with your consent).
 
(ii) Sensitive Personal Information
1.  thumbprint or DNA profile;
2.  physical and/or mental health condition;
3.  religious belief;
4.  commission or alleged commission of any offence or contravention of law;
5.  expression of opinion; and/or
6.  such other sensitive personal information required (with your consent)
 
If you are supplying personal data of other parties such as your family members, legal guardians, nominees, directors, shareholders or officers, please do ensure that you have obtained their consent and bring this Privacy Statement to their attention.

Your personal data with us is obtained from various sources. This includes:
  1. information provided by you or sources authorised by you;
  2. information obtained from legally and publicly available sources;
  3. information released to us by the authorities/other persons, with or without your knowledge or involvement as part of our statutory functions and for recruitment purposes;
  4. biometrics, digital footprints, geolocations, video images and voice recordings obtained during your interaction with us, whether physically or through digital channels.

IP Address
An IP address is a number that is automatically assigned to your computer when you signed up with an Internet Service Provider. When you visit our website, your IP address is automatically logged in our server. We use your IP address to help diagnose problems with our server, and to administer our website. From your IP address, we may identify the general geographic area from which you are accessing our website. Generally we do not link your IP address to anything that can enable us to identify you unless it is required by law and regulation.


Information on Cookies

Third party companies may use persistent cookies to analyze your surfing behavior on and your visit to our website as well as other web sites enabling us to improve our website and our services. Website analytics platforms may be used to collect unidentifiable information for reports such as impression reporting, demographic reporting and interest reporting.
 
Page Tags and Hashed Data 
Our third party advertising companies may place cookies or page tags on some of the pages you visit on our website. These cookies or page tags are designed to collect non-personally identifiable information in order to analyze your interests and searches when visiting our website and may serve you advertisements specifically tailored to your interests and searches when you are visiting our website or other websites or when using mobile applications. The non-personally identifiable information collected through cookies and page tags may be shared with other third parties for purpose of managing and targeting advertisements and for market research analysis. In addition, we may share one-way hashed (undecipherable) data with third party vendors using advertisement targeting products. Such third party vendors typically use hashed device identifiers to link such identifiers to their own users and to serve custom ads based on users' prior visits to our website. As a consequence, third party vendors may show our and/or our partners’ ads on other websites or mobile apps.
 
Advertising 

We may use a combination of the above cookies and page tags to tailor your experience with our website, our mobile application and our ads to your preferences. We use display and search remarketing to tailor ad content for a better experience. We takes reasonable efforts to not collect, and to prevent the use of, personally identifiable information in third party advertising solutions.

We may process your personal data for the following reasons:
  • To assess your application for any of our products and services or continue provisioning of the products and/or services (whichever is applicable).
  • To administer your insurance policy / Takaful certificate and any claims made against your policy / Takaful certificate.
  • To manage and maintain your account with Etiqa.
  • To continue performing the contractual obligations entered into between Etiqa and you.
  • To respond to your enquiries and complaints and to resolve disputes.
  • For internal functions and to support the Maybank group such as evaluating the effectiveness of marketing, market research, statistical analysis and modelling, reporting, audit and risk management and to prevent fraud from time to time.
  • To provide you with information on products and/or services of Etiqa and Maybank Group.
  • To prevent fraud or detect crime for the purpose of investigation.
  • For security reasons in particular personal data collected from close circuit security surveillance cameras.
  • For any purpose required by law or regulations.
If you are a beneficiary and not a policyholder / certificate holder, we will only process your personal data for purposes relating to administering the insurance policy / Takaful certificate.

Subject to compliance with legal and regulatory obligations, your personal data will be shared:
  1. Maybank Ageas Holdings Berhad, Etiqa Life Insurance Berhad, Etiqa General Insurance Berhad, Etiqa Family Takaful Berhad, Etiqa General Takaful Berhad, Etiqa Life International (L) ltd or Etiqa Offshore Insurance (L) Ltd, as the context may require
  2. within the Maybank Group of companies;
  3. with law enforcement agencies and regulatory bodies, with whom we are obliged to do so under certain circumstances;
  4. when doing so is necessary to protect your interests and when obtaining your consent prior to doing so is not practicable;
  5. with third parties with whom we have contracted with to provide certain services. These third parties are required to observe the same privacy standards that we have; and
  6. with parties with whom we have obtained your consent to share.
Within and outside of Malaysia.
 
While we may share your data within the Maybank Group of companies and with certain strategic partners for the purpose of introducing products and services which we believe may be beneficial to you, we will not contact you for marketing purposes unless you have expressed your consent for us to do so. We also wish to assure you that we will not sell your personal data to any third party.
 

We will do our utmost to protect the privacy of your data, be it in physical or digital form. This includes having in place procedures and security measures that meet international best practices. These measures are regularly reviewed to ensure that they are effective and adequate. All our staff members and authorized third parties will be required to comply with these measures and practices.

You have the rights to request access to the personal data that you have provided to us.  However, there may be a cost involved, depending on the nature of the data requested.
 
You also have the rights to withdraw your consent for us to process the personal data provided by you.  However, the withdrawal of your consent may affect the products/services that we can extend to you.
 
You may also change or correct the personal data that you have provided to us.  Please contact us if there are changes to your personal data, or if you believe that the personal data we have about you is inaccurate, incomplete, misleading or outdated.

Where the data protection law applicable to our processing of your personal data does not provide for a right or set out limitations and exemptions which we may rely on, we have the right to deny your request or allow such request at our discretion.

We will only retain your personal data for as long as necessary to fulfill the purpose(s) for which it was collected or to comply with legal, regulatory and internal requirements.

We may update this Privacy Statement from time to time.  Please periodically review this Privacy Statement to stay informed on how we are protecting your information.
 
We provide the Privacy Statement in both English and Bahasa Malaysia. In case of any inconsistency between these two, the English version shall prevail. In case there are inconsistencies on how we collect or use your personal data between this Privacy Statement and the terms and conditions of your specific product or service or other contractual documents, the terms and conditions of your specific product or service or other contractual documents shall prevail.

If there are any changes to your personal data or if you believe that the personal data we have about you is inaccurate, incomplete, misleading or not up-to-date, please contact us so that we may take steps to update your personal data.

You have the right to access your personal data. If you would like to request access to your personal data, please fill in the Access Request Form which is available at all our branches/ Customer Service Centers and send to us via email to PDPA@etiqa.com.my. Please note that depending on the information requested we may have the right to charge a small fee for the processing of any data requested. We may also take steps to verify your identity before fulfilling your request for access to your personal data.
